OPTICON NEW YORK TERMS
These Opticon registration terms (“Opticon Terms”) govern your registration and participation at Opticon US in 2025. By registering for Opticon US, you agree to comply with these Terms. REGISTRATION To attend Opticon, you must register. Registration is only confirmed upon your receipt of our confirmation email. Registrants must be 21 years of age to register for, and attend, Opticon. Optimizely reserves the right at its sole discretion to refuse your registration application. HOTEL AND TRAVEL BOOKINGS AND INSURANCE Optimizely recommends booking fully refundable travel and accommodation and ensuring the registrant takes out appropriate travel insurance.
CANCELLATION AND REFUNDS
Optimizely reserves the right at its sole discretion to refuse or cancel your registration. If we cancel your registration, we will refund your registration fee. Your refund will be processed in accordance with Optimizely’s standard business practice for event refunds. We will endeavor to refund your paid registration fee within twenty-one days. Your registration is non-cancellable, and non-refundable. However, you may transfer your registration to a work colleague in your same company. Substitutions from another company are not permitted, and entry will be denied. There is no deadline for registration substitution within your organization. To initiate a substitution, re-access your registration using the ‘Modify Registration’ function in your confirmation email and click on the “Transfer Registration” link at the bottom of the page. Substitutions will not automatically update your hotel reservation. You will be responsible for contacting the hotel to update your booking. Optimizely assumes no responsibility to you or your substitute for any penalties or added charges by the Hotel by reason of your changes due to the change of registrant. If you cannot transfer your registration and wish to receive a refund, cancellation must be completed by the following dates:
- Full refund by 10 July 2025 (11:59pm PST).
- 50% refund by 8 August 2025 (11:59pm PST)
For cancellation requests prior to 8 August 2025, please refer to your confirmation email. Cancellation requests after 8 August 2025 have no entitlement to a refund, although Optimizely will consider any such requests in good faith, based on the special circumstances of the request. These cancellation requests should be emailed to opticon@kcimanagement.com for consideration. Supporting documentation may be requested. Opticon no-shows are ineligible for a refund.
VIDEO/PHOTO CONSENT
Opticon is being filmed. When you enter Opticon, you may be in areas that are being filmed by video, audio recorded and/or photographed - (“Opticon Digital Media”). By your registration and by your entry into the Opticon, you are consenting to (i) the Opticon Digital Media, and (ii) the capture of your image and anything spoken by you in that Opticon Digital Media, and (iii) Optimizely’s utilization of that Opticon Digital Media as outlined below and the storage and processing of your image and voice, howsoever recorded, or for any other referential, marketing and sales purposes by Optimizely. Optimizely will hold all copyright in the Opticon Digital Media. Optimizely is authorized to record, edit, adapt, create an excerpt, copy, exhibit, distribute, reproduce, publish (including online on any Optimizely and authorized Optimizely partner and agent external website or internal intranet site), re-publish, advertise, telecast, broadcast, steam, download, upload, store, archive, transmit and /or otherwise make available to the public, in print, video, and /or audio, any Opticon Digital Media and all derivatives for the purposes of promoting Opticon and other associated or lawful purpose, including utilizing any Opticon Digital Media in subsequent Optimizely customer marketing events, such as (by way of example) for future Opticons, without payment or any other consideration to you. You release Optimizely and its affiliates and their authorized Opticon agents, and their respective employees and representatives, from any and all claims (including in respective of compensation) of and otherwise incidental to any such recording and its incorporation into Opticon Digital Media and Optimizely’s use of that Opticon Digital Media. SESSION LIMITS Opticon sessions, including breakouts, may have attendance limits. Attendees must observe all attendee limits throughout Opticon.
OPTICON POLICIES
Optimizely’s Opticon Policies (a copy of which are attached to these Opticon Terms, and which will be published by Optimizely prior to Opticon, as updated from time to time), are incorporated into these Opticon Terms.
OBJECTIONABLE BEHAVIOR
Optimizely (including its affiliates and agents) and their respective directors and employees and the Venue, and anyone acting any lawful authority of the city and the state of the Venue have the right to eject you, and/ or suspend or terminate your participation at Opticon, where any attendees conduct is deemed objectionable, disorderly, or disruptive, or in violation of any law.
DISCLAIMERS
Distributed Opticon materials are provided for informational purposes only, without any binding representation or warranty of any kind. Optimizely shall not be liable for damages of any kind resulting from any errors or omissions in the Opticon materials, nor shall Optimizely be liable for any damages resulting from the use of the Opticon materials or other information conveyed distributed or otherwise made available at Opticon.
DISCLOSURE AND SAFE HARBOR
Any Optimizely product roadmaps are intended to outline our general product direction. Any such statements are intended for information purposes only. They are not commitments to deliver any material, code, or functionality, and should not be relied upon in making purchasing decisions. Attendees who purchase Optimizely’s products should make their purchase decisions based upon features and functions that are currently available. Any unreleased services, features, functionality, or enhancements referenced in any document, roadmap, blog, website, press release, or public statement that are not currently available are subject to change at our discretion and may not be delivered as planned or at all. The development, release, and timing of any features or functionality remains at the sole discretion of Optimizely.
ATTENDEE FEEDBACK
Any input, comments, or suggestions from Opticon attendees to Optimizely during, or after, Opticon, regarding Optimizely’s business and technology direction, and the possible creation, modification, correction, improvement or enhancement of any Optimizely product (“Feedback”) may be retained by Optimizely, and freely used, incorporated and/or or otherwise exploited such Feedback without restriction, compensation or attribution to the source of the Feedback.
CHANGE OF SESSIONS/ EVENTS
Optimizely reserves the right to change proposed Opticon advertised sessions, beak-outs, Sponsors and entertain at any time due for any reasons.
UNFORESEEN CIRCUMSTANCES
Optimizely reserves the right to refuse or cancel any registration at any time due to any unforeseen circumstances (including any force majeure events, including any pandemic and related health orders, City, County of State orders, or Site cancellation). Optimizely shall have no liability to you for any such cancellation, other than our liability (and which will be you sole and exclusive remedy) to refund to you paid registration fee, if any. Cancellation of travel and hotel reservations shall be a registrant’s exclusive responsibility and cost.
OPTICON CANCELLATION
Optimizely reserves the right to postpone or cancel Opticon or any Opticon session at any time. Optimizely will endeavor to provide advance notice as is reasonably practical under the relevant circumstances. Optimizely shall have no liability to you for any such suspension or cancellation, other than our liability (and which will be you sole and exclusive remedy) to refund to you paid registration fee, if any. Cancellation of travel and hotel reservations shall be a registrant’s exclusive responsibility and cost.
NO LICENSE
The provision of any material to you at Opticon does not constitute any grant of rights from or by Optimizely other than the right to use the provided material for your own informational purposes, and does not constitute a license to reproduce, distribute, make available or otherwise use or commercialize any such provided material.
PRIVACY

SPECIAL REQUIREMENTS
During registration, and prior to, or at Opticon, we may ask you questions about your health for the purpose of identifying, and accommodating, individuals with special needs dietary requirements. You are at liberty to respond to our queries or decline to respond. If you decline to identify any special requirements, Optimizely may not be able to make appropriate accommodation. Optimizely will use reasonable efforts to meet any disclosed special requirements, although Optimizely cannot guarantee that it will be able in every case, although it will endeavor to do so.
OPTICON MOBILE APP
A mobile application that features Opticon information, and allows session and breakout planning, and networking features, may be available. Use of the Opticon app is entirely discretionary, as are the personal information and networking features. Your personal information (your name, company and email address) is not shared with other attendees, unless you consent within the App. Optimizely’s privacy notice applies to your use of the Opticon app –https://www.optimizely.com/legal/privacy-notice.
OPTIMIZELY’S USE OF YOUR INFORMATION
Your contact information submitted during your registration and during your participation at Opticon will be available to KCI Management, Optimizely’s authorized agent facilitating the management of Opticon. That will include use of your mobile number for Opticon updates and notifications, as well as through the identification code printed on your Conference badge and/or wristband. Optimizely will not provide information you provide to us during your registration or during Opticon to any unrelated third parties unless you consent to such sharing of that information.
VIEWS OF OPTICON ATTENDEES
The views expressed by any Opticon attendee, speaker, or sponsor are not necessarily those of Optimizely. All Opticon attendees, speakers, and sponsors are solely responsible for the content of their respective individual or corporate presentations, marketing collateral, or advertising.
NO LIABILITY FOR LOSS OR DAMAGE
Neither Optimizely (including its affiliates and agents) nor their respective directors and employees, nor the Opticon venue shall be responsible to you for any personal injury, illness or property damage arising from or in connection you’re your attendance at Opticon or your participation in any Opticon activities or events, whether formally scheduled or ad hoc. Similarly, neither Optimizely, including its affiliates and agents, nor their respective directors and employees, nor the Venue assume any responsibility to you or for any losses due to theft or loss of your equipment and other personal property.
LIMITATION OF LIABILITY
Neither Optimizely nor any of its agents, Opticon or any Opticon sponsors, contractors, licensees and designees and their respective successors and assigns (“Optimizely Parties”), nor any of its or their affiliates, employees, agents or representatives, shall have any liability whatsoever to you for any loss, injury (including death), expense, or damage, except to the extent any such claims may be directly and solely attributable to the gross negligence or willful misconduct of Optimizely or a Optimizely Party as applicable. Neither Optimizely nor any of the Optimizely parties, nor any of its or their affiliates, shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from registering for or attending the Opticon, alteration of the Opticon schedule, or any error or omission. The maximum aggregate liability of Optimizely and the Optimizely Parties and its and their affiliates for any claim in any way connected with, or arising from Opticon or any Opticon, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the Opticon fees paid by you to Optimizely.
INDEMNITY
By registering for Opticon and attending the Opticon, you agree to indemnify Opticon with respect to damage, loss or theft you cause, or contribute to, of any property of Optimizely (including its affiliates and agents) and the Venue and of any Sponsor and in all cases of their respective directors and employees, and with respect to any injury (including death) of any person attending Opticon you cause or contribute too, howsoever arising.
RELATIONSHIP OF THE PARTIES
These Terms and the activities governed hereby; do not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between the parties. There are no third- party beneficiaries to these Terms.
CHOICE OF LAW AND EXCLUSIVE FORUM
These Opticon Terms, and any and all disputes directly or indirectly arising out of or relating to these Opticon Terms or Opticon, will be governed by and construed in accordance with the laws of the State of New York, without reference to the choice of law rules thereof. Each of the parties hereby irrevocably consents and submits to the exclusive jurisdiction of the state and federal courts located in New York Country, New York, U.S.A., for any such disputes, and hereby irrevocably waives any objection to the laying of venue in such courts. Each party hereby waives any right to jury trial in connection with any action or litigation in any way arising out of or related to these Terms.
ASSUMPTION OF RISK
Your participation in and attendance at Optimizely is completely voluntary. Optimizely does not guarantee admittance to any specific session or keynote and reserves the right to admittance to any Opticon session or keynote to any attendee, at its sole discretion. Unless specified otherwise all events, keynotes, and sessions are seated on a first-come first-served basis. You accept and assume all risks of any and all personal injury or damage to your personal property that you may face while attending the Opticon and waive any claims against Optimizely relating to such risks. SEVERABILITY If any provision of these Opticon Terms is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of these Opticon Terms will remain in full force and effect, and, if legally permitted, such offending provision will be replaced with an enforceable provision that as nearly as possible effects the parties’ intent.
NO WAIVER
No waiver of any rights is to be charged against any party unless such waiver is in writing signed by an authorized representative of the party so charged. ASSIGNMENT You may not assign any of your rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of Optimizely. Optimizely’s sole remedy for any purported assignment in breach of this paragraph shall be termination of these Opticon Terms as it relates to you and your non-participation at Opticon or the Opticon. Optimizely may assign these Opticon Terms, in whole or in part, as necessary for the execution of Opticon without your consent and at its sole discretion. Subject to the foregoing, these Opticon Terms shall bind and inure to the benefit of the parties, their respective successors and permitted assigns. ENTIRE AGREEMENT These Opticon Terms constitute the entire agreement between the parties in relations to the Opticon and supersede all prior and contemporaneous terms, agreements, proposals or representations, written or oral, concerning its subject matter.

We expect all Opticon and Event participants (staff, sponsors, speakers, attendees, and other guests) to observe and respect our Opticon Policies at all Opticon venues and Opticon-related social events. PRIVACY POLICY Optimizely’s privacy notice (https://www.optimizely.com/legal/privacy-notice) applies to our collection of your data during the registration, and in relation to all Opticon purposes.
SAFE ENVIRONMENT POLICY
Optimizely is committed to providing a friendly, safe and welcoming environment for all, regardless of gender, sexual orientation, disability, ethnicity, or religion. We invite all sponsors, speakers, attendees, media and other participants to help us realize a safe and positive Opticon experience for everyone.
AGE POLICY
You must be 21+ to attend the tradeshow.
BADGE POLICY
Opticon, and all sessions and events, requires an official Optimizely-issued badge to attend. You must wear the Opticon badge within the Opticon venue, and it should remain visible at all times. Badges cannot be shared. You must surrender Opticon badge upon request from an Optimizely representative. Any replacement Opticon badge shall be at Optimizely’s discretion. Your badge may be scanned by Optimizely or its authorized agents for security and monitoring purposes. You agree to our scanning of your badge. Optimizely employees and representatives may also ask to scan your badge for the marketing purposes. Their scan of your barcode allows us to collect your contact details, which will be used to contact you after Opticon, and to also send you marketing information about Optimizely’s services and products. If you do not wish to share your contact information with us for those purposes, you are at liberty to not agree to your barcode to be scanned at those sessions and breakouts. Agreeing to have your barcode scanned is not a condition of entry to any session or breakout. Opticon sponsors may ask to scan your barcode on your badge t to collect your contact details, which they may use to contact you for the purposes of Opticon follow-up and to send you marketing information about their products and services. If you do not wish to share your contact information with a sponsor for these purposes, please do not give that sponsor permission to scan your badge. APPROPRIATE BEHAVIOR Be considerate, respectful, and collaborative. Refrain from demeaning, discriminatory or harassing behavior, materials and speech. Be mindful of your surroundings and of your fellow participants. Respect Optimizely’s policies of diversity and inclusion. Alert Opticon organizers and officials if you notice a dangerous situation or someone in distress. The Opticon venue are part of a larger complex shared with venue employees and contractors and members of the public - please be respectful to all all person in these locations.
UNACCEPTABLE BEHAVIOR
Optimizely has codes of conduct which reinforces that unacceptable behavior will not be tolerated under any circumstances, whether by attendees, Optimizely staff, media, speakers, organizers, venue staff or sponsors. All determinations of inappropriate behavior are in Optimizely’s sole discretion, and the decisions of Optimizely’s representatives on-site are final. You will be expected to comply with their directions accordingly. Unacceptable behavior (including material) includes intimidating, , harassing, abusive, discriminatory, derogatory, or demeaning conduct and /or materials by any attendee of Opticon and Opticon-related activities. Optimizely has a zero-tolerance policy with respect to the illicit possession, utilization and consumption of illicit drugs. Optimizely also abides by a responsible alcohol consumption policy. Alcohol may only be consumed during Optimizely-approved events. No personal alcohol may be brought to the Opticon venue. Adherence with the Opticon venue attendance rules and policies is also expected from all Opticon attendees.
CONSEQUENCES OF UNACCEPTABLE BEHAVIOR
Anyone asked to stop unacceptable behavior is expected to comply. If a participant engages in unacceptable behavior, Opticon organizers and officials may take any action they deem appropriate, up to and including expulsion from Opticon without warning or refund. If you are subjected to unacceptable behavior, notice that someone else is being subjected to unacceptable behavior, or have any other concerns, please notify an Opticon organizer or official as soon as possible. Opticon staff will be available to help participants contact venue security or local law enforcement, or to otherwise assist those experiencing unacceptable behavior to feel safe for the duration of Opticon. You can report unacceptable behavior to any member of staff. Staff can be found in Opticon office onsite, or you may email opticon@kcimanagement.com.
SOLICITATION POLICY
Anyone soliciting business in the aisles or other areas, or in another company’s demo pod, will be asked to leave immediately. Additional penalties may also be applied. Please report any violations you may observe to Opticon on-site staff or opticon@kcimanagement.com
UNAUTHORIZED MATERIAL DISTRIBUTION POLICY
Distribution of flyers, notes, pamphlets, or brochures at Opticon, including in any session at Opticon, including any connected or related social event, without the prior written consent of Optimizely is not permitted. Any authorized distributed material may be confiscated by Optimizely and destroyed.

Optimizely may update these Optimizely Policies from time to time.
